Terms of Service

1. Agreement

By accessing or using SplitMonk (“the Service”), operated by Obelisk Data Michał Pogoda-Rosikoń, NIP 8993014513, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of service

SplitMonk is an AI-powered conversion optimization platform that scans your website, generates copy and layout improvements, deploys them as A/B experiments via an edge script, and measures conversion performance autonomously.

3. Account registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Attempt to reverse-engineer, decompile, or extract source code from the Service.
• Use the Service to generate deceptive, misleading, or fraudulent content.
• Interfere with or disrupt the integrity or performance of the Service.
• Resell or redistribute access to the Service without our written permission.

5. Your content

You retain ownership of the content on your websites. By connecting your site to SplitMonk, you grant us a limited license to access, analyze, and modify the presentation of your site content for the purpose of running optimization experiments. We do not claim ownership of your content.

6. Pricing and payment

Paid plans are billed monthly in advance. Prices are listed on our pricing page and may change with 30 days' notice. All fees are non-refundable except as required by applicable law. Payments are processed by Stripe.

7. Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. Your experiments will stop running and your data will be retained for 30 days after cancellation, after which it may be deleted.

8. Service availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance or updates that temporarily affect availability. We are not liable for any losses arising from service interruptions.

9. Limitation of liability

To the maximum extent permitted by law, SplitMonk and Obelisk Data shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability shall not exceed the amounts you paid to us in the 12 months preceding the claim.

10. Disclaimer

The Service is provided “as is” without warranties of any kind. We do not guarantee that AI-generated suggestions will improve your conversion rates. Results depend on many factors outside our control.

11. Governing law

These Terms are governed by the laws of Poland. Any disputes shall be resolved by the courts in Wrocław, Poland. For EU consumers, mandatory consumer protection laws of your country of residence may also apply.

12. Changes to terms

We may modify these Terms at any time. We will provide notice of material changes via email or on the website. Continued use after changes constitutes acceptance of the updated Terms.
